EED Directive - the clock is ticking
On 15 May 2024, the requirements of the European Energy Efficiency Directive (EED) became mandatory for all 27 members of the European Union. For the data center industry, this means specific annual reporting obligations, with the first deadline already falling on 15 September 2024. The obligation will apply to all owners and operators of data centers with the capacity of installed IT infrastructure above 500kW, i.e. colocation server room operators, telecommunications operators, banks, university supercomputing centers and other large enterprises with their own on-prem model data processing centers, excluding defense facilities. One of the goals of the PLDCA is to coordinate and support local organizations in ensuring compliance with the requirements of the Directive through active communication and cooperation with the European Data Center Association (EUDCA) and other national industry associations. The following study aims to provide an overview of EED requirements for data centers and the broader context within which these activities are undertaken.
The Directive predicts that raising the EU's 2030 energy efficiency target is expected to lower energy prices and have a decisive impact on reducing greenhouse gases, accompanied by the development and spread of electrification, the use of hydrogen, e-fuels and other technologies necessary for the green transition. Greater energy efficiency is also particularly important for the EU's energy supply security, by reducing dependence on fossil fuel imports from third countries, a particularly important aspect in the context of current geopolitical developments in our region.
The three sectors with the highest estimated potential for energy savings outside of industry are transportation, buildings (especially public buildings) and the information and communications technology (ICT) sector.
Article 12 of the Directive refers directly to data centers - according to Annex A, sec. 2.6.3.16 of Regulation (EC) No. 1099/2008,[i]defined as a structure or group of structures used to house, connect and operate computer systems/servers and related equipment used to store, process or distribute data and similar activities.
By 15/05/2024 (deadline now postponed to 15/09/2024), and annually thereafter, Member States must require the owners and operators of each DC located on their territory with an installed electricity demand of 500kW or more to make public the information specified in Annex VII, except for information subject to EU and national laws protecting trade and business secrets and confidentiality.
The European Commission will create an EU database on data centers, publicly available at the aggregate level, and will evaluate available data on the energy efficiency of data centers and report to the European Parliament and Council with potential legislative proposals containing further measures to improve energy efficiency.
One feasible measure is to establish minimum performance standards and assess the feasibility of transitioning to a net-zero-emission DC sector, in close consultation with relevant stakeholders - highlighting the important role of cooperation at the local level under the aegis of industry associations. Such proposals may specify a timeframe within which existing data centers are to be required to achieve minimum efficiency.
In addition, Member States are to encourage owners and operators of any DC located on their territory with an installed IT infrastructure electricity demand of at least 1MW to take into account the best practices referred to in the latest version of the European Code of Conduct on Data Center Energy Efficiency [ii][ii]
Annex VII to the Directive sets out the minimum requirements for monitoring and publishing the energy performance of data centers:
- the name of the data center, the name of the owner and operators of the data center, the date on which the data center started its operations and the municipality where the data center is based;
- the floor area of the data center, the installed power, the annual incoming and outgoing data traffic, and the amount of data stored and processed within the data center;
- the performance, during the last full calendar year, of the data center in accordance with key performance indicators about, inter alia, energy consumption, power utilization, temperature set points, waste heat utilization, water usage and use of renewable energy, using as a basis, where applicable, the CEN/CENELEC EN 50600-4 ‘Information technology – Data center facilities and infrastructures’, until the entry into force of the delegated act adopted pursuant to Article 33 (3) ( delegated acts - under a common EU system, a definition of DC sustainability indicators will be established and key performance indicators and their measurement method are set).
The detailed requirements are outlined in a delegated act dated 14/03/2024. [iii]
Size categories of data centers were be based on the data center’s information technology installed power according to the following breakdown included in Annex IV[iv] of the delegated act
- a) very small data center: 100 – 500 kW;
- b) small data center: 500 –1000 kW;
- c) medium size data center: 1 – 2 MW;
- d) large data center: 2 –10 MW;
- e) very large data center: >10 MW.
According to Article 32 EED, Member States shall lay down the rules on penalties applicable to infringements of national provisions adopted pursuant to this Directive and shall take all measures necessary to ensure that they are implemented. The penalties provided for shall be effective, proportionate and dissuasive. Member States shall by 11 October 2025 notify the Commission of those rules and of those measures and shall notify it without delay of any subsequent amendment affecting them.
Another article of the Directive that may indirectly affect DC is Article 11 – Energy management systems and energy audits. It requires enterprises with an average annual consumption higher than 85 TJ (~23,6GWh) of energy over the previous three years to implement an energy management system certified by an independent body, in accordance with the relevant European or international standards. This requirement takes effect by 11/10/2027.
Additionally, enterprises with an average annual consumption higher than 10 TJ of energy (taking all energy carriers together) over the previous three years, taking all energy carriers together, which do not implement an energy management system are subject to an energy audit - carried out in an independent and cost-effective manner by qualified or accredited expert and implemented and supervised by independent authorities under national legislation.
An audit of enterprises with energy consumption above 85TJ must be carried out by 11/10/2026. The enterprises concerned must draw up a concrete and feasible Action Plan on the basis of the audit which will be submitted to the management of the enterprise.
Although this article does not directly refer to data centers, the limits for individual energy consumption criteria (10TJ / 85TJ) will be reached by facilities with an installed IT infrastructure electricity demand of about 230kW / 1900kW.
Enterprises subject to the requirement to implement energy management systems or energy audits will be encouraged to report annual energy consumption in kWh, annual water consumption in cubic meters, and energy and water consumption compared to previous years.
The EED requirements also impose a number of decarbonization requirements on other industries, including the power and heating industries. This raises a number of opportunities for cooperation and synergy between these industries and the data center industry, and will be one of the important areas of further activity for the PLDCA.

According to PMR's latest report, the total value of the cloud computing market in 2023 will reach PLN 3.9 billion, a 34% year-on-year increase. The potential for further growth in the coming years remains evident. PMR's forecasts for 2024 show that the cloud market is expected to grow to PLN 4.8 billion in 2024, and to approach PLN 13 billion in 2029.

There is also no change in the attitude of large companies in Poland when it comes to planned spending. Fewer than one out of 100 companies say they want to cut back on cloud spending. The use of cloud computing is associated with ever-increasing costs, which are not always dictated solely by new projects and investments, but also by changes in the pricing policies of cloud providers. Nor can we forget about technological innovation. The use of artificial intelligence in organizations is set to become one of the top priorities.

Another important factor that opens up new prospects for the cloud computing market is also the development of infrastructure in Poland, including data centers and networks, including mobile (5G) and fixed (FTTx) access. It will become possible to collect data from devices, send it to the cloud and receive real-time feedback. The infrastructure expansion will lay the groundwork for a range of new applications that were not available with older technologies.

Investments by major hyperscalers in existing cloud regions, as well as those planned, play an important role in the context of the growing data center market, which is able to scale to a much higher level, in terms of the power resources used to power cloud servers. The decisions of Google Cloud Platform and Microsoft to locate cloud regions in Poland based on data centers located in the country and cooperation with local partners, both in terms of colocation services and deployment projects, are a prime example.
AWS has decided to launch a zone, but a region in Poland in the future is not out of the question either. The activity of the world's three largest IaaS providers and their investments in Poland show how important the domestic market is for them now and how important it is from the point of view of at least some customers to locate physical infrastructure in Poland.
The hyperscalers also want to address especially regulated industries, for which minimizing risks about processing data outside a domestic location is a priority. It is not that regulations do not allow processing outside Poland, but they still leave room for interpretation, making companies and institutions unwilling to risk unnecessary disputes with regulators.
PMR's forecasts indicate that the share of the public cloud in the total value of the data center market in Poland will increase threefold between 2024 and 2030, reaching 50% by the end of the forecast period.

In parallel with the market shaped by global public cloud providers, who are increasingly competing on the added value derived, for example, from the AI functionality they provide, there is a growing market of providers focused on managing multiple platforms and integrating public cloud services with corporate data centers. The needs of business in this area will grow. The growth of hybrid and multi-cloud environments, as well as consulting, deployment or integration services in the area of cloud computing, is an important trend. This is an opportunity for service providers and data centers operating locally.

At the same time, it should be borne in mind that even despite the high level of penetration already achieved, cloud computing will continue to be one of the main areas of budget allocation by companies in the coming years. This is indicated, among other things, by the European Commission's new agenda, "Path to the Digital Decade". According to its assumptions, by 2030 a minimum of 75% of European companies should use cloud-based solutions. At the same time, during the forecast period, it is expected that further initiatives - related, for example, to the development of a sovereign European cloud - will gain in importance. This only confirms that the current direction of the market in the coming years will be maintained.

The material was prepared on the basis of PMR’s reports: "Cloud computing market in Poland 2024. Market analysis and development forecasts for 2024-2029" and "Data center market in Poland 2024. Market analysis and development forecasts for 2024-2029".
For the purpose of the reports, PMR conducted a survey on a sample of 500 large companies and SMEs in Poland. The survey was conducted in Q1 2024 using computer-assisted telephone interviewing (CATI) techniques.

We are pleased to announce that Piotr Kowalski has joined our team as Managing Director of the Polish Data Center Association (PLDCA).
His extensive experience in the industry - both on the Polish and international markets - will be an invaluable asset in further development of our organization. PLDCA has been growing organically through acquisition of new members and establishing relationships with other industry associations in Europe. Our action plans, including the activation of newly acquired members in PLDCA activities, the development of educational activities, the building of a media presence and the intensification of cooperation with partner Associations, including the EUDCA, require active management.
Therefore, the Board of Directors decided to entrust the operational management of the Association to Piotr Kowalski. 一 "I am convinced that Piotr's commitment and his vision for the Association's development will contribute to the achievement of its statutory goals and strengthen PLDCA's position as a partner institution in the data centre industry in Poland and Europe" 一 commented Slawomir Koszolko, President of the PLDCA Board.

Nowadays, there seems to be no conference dedicated to digital transformation where the term "artificial intelligence" isn't used in every possible context. Artificial intelligence interests individual users who create images in the style of Van Gogh or compose music like Tchaikovsky on their computers. It interests companies looking for ways to offer services faster, cheaper, and more tailored to the individual needs of customers, and governments see in this technology not only a chance for another technological leap in the economy but also a huge challenge and risk – including in terms of national security. Therefore, it's no surprise that reports and studies highlighting the potential and possible directions for AI development appear time and again. All of these have one thing in common - they emphasize the importance of preparing the appropriate technical infrastructure to ensure safe and efficient processing of zettabytes of information, which are the basis for the digital economy.
AI applications, especially deep learning algorithms, require significant computing power to process and analyze vast amounts of data. This demand for computing resources will drive the need for stronger and more efficient equipment in data centers. The importance of edge computing, where AI computations are made as close to the data source or end-users as possible to avoid delays, will also grow.
As artificial intelligence becomes more widespread and touches on such critical areas as medical data, data security becomes a critical issue. Interestingly, it is artificial intelligence itself, used as a tool, that constitutes one of the fastest-growing risks to the security of this data. Hence, the infrastructure used for data processing increasingly utilizes AI-based mechanisms for its security. This real arms race in the field of using AI mechanisms to ensure data security obviously promotes large, professional data processing centers, which can benefit from economies of scale and the experience of global teams implementing the latest solutions in real-time.
Just as artificial intelligence needs secure and efficient data processing centers, these centers need energy. According to the International Energy Agency (IEA) in 2021, data centers' energy consumption was between 220 and 330 terawatt-hours (TWh), which accounts for about 0.9–1.3% of total global electricity demand. This is more energy than some countries use each year. It is worth noting that energy efficiency is an element that, with increasing needs, may decide the transfer of data processing to professional centers.
Reading the Deloitte report from January 2024, it is worth noting that over 60 percent of managers participating in the study are not only interested but even fascinated by the possibilities of using AI technology. More than half of them believe that this will increase productivity, one-third think it will lower operating costs, and nearly 30% believe that AI will improve their products and services. Perhaps more importantly, nearly 80% of respondents believe that the use of AI will lead to the transformation of their businesses over the next 3 years.
Thus, everything indicates that artificial intelligence will be the driving force behind the digital transformation in the coming three years, which in turn means demand for increasingly efficient and effective equipment, increased network bandwidth, the development of edge processing capabilities, and greater energy consumption. All of this in a format that creates maximum security for data processing. In other words - demand for professional data processing centers."

The development of data centers in Poland is important due to the rapid growth of data storage and processing needs. Investments in this type of infrastructure can contribute to the country's competitiveness in the technological field and support economic development by generating jobs and attracting investors. At the same time, it is important that this development goes hand in hand with carbon reduction policies and data security to ensure stability and confidence in the IT sector.
Vertiv, as a leading manufacturer of critical infrastructure solutions for data center facilities, pays particular attention to the growing expectations in the context of the energy efficiency of the offered systems and the growing IT power density. The Polish data center market, with Warsaw as the main point, is developing extremely dynamically and is very strong. It is currently on par with Western European markets. This is mainly due to investments by global colocation and cloud providers, including some of Vertiv's main customers for prefabricated modular data center (PFM) solutions. They account for about 70 percent of Vertiv's solution sales in the Polish market. The remaining 30 percent of customers are in the enterprise segment (20%) and telecommunications (10%). PFM data center deployments are most often associated with investments in greenfield projects.

Some analysts suggest around 10-20% per year, and AI implementations will also be one of the main drivers of high investment dynamics. Additionally, spending in Poland, as in the European Union as a whole, will be driven by regulations in the areas of green energy and environmental protection, including the Fit for 55 package.” - Igor Grdic, Regional Director Central Eastern Europe, Vertiv.
Thus, from Vertiv's perspective, the key trends that will affect the data center market in the near future, both globally, in Europe and in Poland, are:
- artificial intelligence, which will create many opportunities for optimization, new designs and modernization of data centers;
- intensification of the search for alternative energy storage solutions;

- the race to the cloud, and new challenges in ensuring the highest level of security for stored data.
